More INSANE Policy Violations - and the impossible requests that go with it.

So yesterday we suddenly get 8 brand spanking new policy violations - this time for the "Michael Jordan" trademark. Now I'm not sure why the other 40 Michael Jordan items we have available did not get flagged, but hey, 8 is enough!

We have been in the Sports Memorabilia business for nearly 30 years. Back in 2016, we spent a great deal of time and capital to become one of only a handful of authorized Upper Deck Authenticated online authorized retailers. We even provided Amazon with that exclusive contract.

Michael Jordan is an exclusive client of Upper Deck Authenticated. Our contract specific says we cannot sell any Michael Jordan items that are NOT Upper Deck Authenticated. Even more, Amazon acknowledges BOTH that Michael Jordan has authorized Upper Deck to sell his items, AND that we are an Authorized reseller for Upper Deck. End of story, right?

WRONG. Amazon is saying that along with all this, we also need an authorization from Michael Jordan to sell his items on Amazon. Yes, one of the biggest and most famous athletes and his team is going to go through the time and effort to provide us with something that likely does not nor will ever exist.

What needs to change is Amazon's scorched earth standard operating procedure and, once again, inject some common sense into their practices. I have spent over 20 hours on ridiculous policy violation issues in the last week alone, much of which is caused by Amazon own technical decisions to prevent items in violation from being edited, yet to ask for items to be edited to be removed from violation. We have had to go to the Product Catalog team on more than one occasion just so we could edit an item to make it compliant with a policy that we didn't know and had no way of knowing existed.

So while I'm guessing we are approaching our last days on Amazon because the 0.05 percent of our 19,000 items are being flagged by some computer and we are being threaten daily or hourly from deactivation, we tread on because, well, apparently that's what Amazon asks for.

I understand that you have some concerns about some policy violations due to the trademark Michael Jordan.

Michael Jordan is an exclusive client of Upper Deck Authenticated. Our contract specific says we cannot sell any Michael Jordan items that are NOT Upper Deck Authenticated. Even more, Amazon acknowledges BOTH that Michael Jordan has authorized Upper Deck to sell his items, AND that we are an Authorized reseller for Upper Deck.

I can see that you have a contract from Upper Deck Authenticated. According to our policies when it comes to customized, brands should be the third-party seller, not the product brand being consumed. Your contract would need to explain the trademark is approved to be listed under the Upper Deck Authenticated brand. If your contract does not specifically state that the product can be listed under a different brand name, then the ASIN needs to be listed under the brand that is associated with the trademark being used. We may request a letter of authorization from the brand you are listing under.

·      What is the brand associated with these listings?

·      Does your contract approve the trademark to be listed as a different brand?

·      Are you selling a Michael Jordan product, or a customized product using a different brand’s trademark?
