Seller Fulfilled Suspended for Dropshipping Violation

Hello Moderators,

My Account Merchant Fulfilled part is Deactivated due to a second Dropshipping Violation in the same year. I have been on Amazon since 2016 and have never been a Dropshipping business and it is also evident from the shipping we used to buy off Amazon Seller Central. In January of this year, a brand sent us a Cease and Desist letter to stop selling their product, which we were purchasing from the supplier. The brand also emailed us and copied our supplier in it. The supplier refused to sell the products and in the meantime, we had an order for the same brand. In order to provide an immediate resolution, we bought the item from Amazon and drop shipped it to our customer. We never thought buying off Amazon would be a violation. However, we realized and admitted our mistake and shared the issue with an Amazon associate at that time. Thanks for accepting our reason.

In March of this year, due to some family issues, I was out of town and had no access to our warehouse. There was an order fulfilled from our warehouse before I had traveled, and 2 or 3 other orders that were on the way but never reached the buyer. The buyer related to one order reached out and requested some parts missing in factory sealed box. I contacted the buyer and inquired about the missing part and requested him if he would be fine if the missing parts were fulfilled from a 3rd third-party supplier since I had no access to my own warehouse. The buyer consented and then I proceeded to fulfill the missing parts from a 3rd party supplier. The account got suspended right after the delivery of those missing parts.

Now everything I mentioned above has evidence. My copies of tickets for flights during that week, order fulfillment from our warehouse with FedEx trackings from our FedEx account, previous history of Buy Shipping on Amazon, the email exchanges between seller and buyer and getting his consent, as proof of our own inventory the pictures of the inventory and warehouse, warehouse lease documents etc. I prepared my appeal with at least 10 pages of evidence. The purpose of presenting evidence in the appeal was not to contradict the dropshipping violation, however, to emphasize that the Business Model has never been a dropshipping. I have started FBA since then but it has not been very successful due to low profit margin. We are getting a good discount with FedEx and the storage fee was an extra fee for the product as we already store them in our warehouse. The appeal was rejected multiple times despite admitting the mistake

I would kindly request the Amazon moderator, a real person to step in and provide me a one-to-one assistance. I would like to be honest here and mention here that Amazon did help my business boost up in the past, and I am hopeful it will give me a chance again to learn from our mistakes.

I am not a moderator, but maybe I can help to shed some light as to why Amazon did what they did.

As a person, I am sorry to hear that you had a family emergency. but, to Amazon, you are a business. businesses do not have families. They do not have family emergencies - they may have business emergencies, but those eergencies do not revolve around individuals. A business would not fly to anoher part of the country to tend to a person.

If it is not too late, Amazon wants to know how you will change your busines practices so that your business will not dropship in the future. Does someone else have access to your warehouse and could ship in the business owner's absense? Can you put your store in vacation' mode when you are away so that other orders do not come in that you would not be able to ship on time from your warehouse?

You cannot handle this problem as a person, but as a business.

Understand that you have concerns regarding the seller-fulfilled offers have been deactivated.

Drop shipping or allowing a third party to fulfill orders to customers on your behalf, is not acceptable unless it is clear to the buyer that you are the seller of record.

When a customer sees packaging and invoices or receipts identifying a seller that is not you nor Amazon, they may be confused about how their order is being fulfilled and who they should contact with any problems or questions.

If you intend to fulfill orders using another company’s fulfillment service, a third-party logistics company, or a drop shipper, you must always:

* Have an agreement with your supplier where you are the only seller of record and the only entity identified as the seller of your products on all packing slips, invoices, external packaging, or any other information included or provided in connection with the products;

* Remove any packing slips, invoices, external packaging, or other information identifying a different seller or third-party supplier prior to shipping the order; and

* Remain responsible for accepting and processing customer returns, and always comply the

* Business Solutions Agreement (BSA) and applicable Amazon policies.
