Brand Registry!

I have been attempting to gain approval for our brand registry application for the past 2 months, to no avail. Here is a summary of what I have provided as evidence that we own the brand we are applying for:

  • Screenshot that our Seller Central Account is clearly owned by the entity that owns the brand.
  • Screenshot of bank account of the entity that owns the brand and Seller Central Account.
  • Screenshot of GS1 data hub listing all products that use our brand.
  • EIN letter from IRS for the entity that owns the brand and the Seller Central account.
  • Delaware Certificate of Formation for the entity that owns the brand and the Seller Central account.
  • My driver’s license (business owner). My name is on the EIN Letter, USPTO search, etc.
  • Screenshot of ownership clearly being established on the USPTO search.
  • Product images.

Also, we used amazon’s IP Accelerator to complete the trademark application process (Idea Legal).

I have had the customer service team try and re-escalate the case but am still receiving a response from brand registry that “the decision was made correctly”. This clearly is not the case.

Furthermore, brand registry has marked our application as “abusive”. Which, I am unsure how that is possible since we don’t have any products for sale because we have to wait for our brand registry application to be approved, and our application has had virtually no contact with anyone on the brand registry team.

It has been 26 days since I have heard anything from brand registry, and do not anticipate hearing from the at least “90 days”.

I am humbly seeking any assistance to possibly resolve this brand registry issue. I have run into countless dead ends with no possible resolution in the foreseeable future. So much so, that it has become apparent to me that we will either have to rebrand our entire company, and its product lines, or not sell our products on amazon.

Any assistance would be greatly appreciated. Thank you.

Despite using an Accelerator attorney, have you checked if they are subject to an Order for Sanctions from the USPTO or listed as an entity on the Potentially Misleading Solicitations webpage?

Also, go over everything with a magnifying glass looking for a missing 'period' or 'comma'. Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

When Amazon says something must match they mean EXACTLY!

The only thing abusive here is Amazon flagging good, honest, and hard working sellers as abusive for no reason.

Unfortunately, this is all too common (search the forums). Happened to us too. Working with the Brand Registry team is impossible, they are siloed and you cannot talk to them directly. Their internal policy is to share zero information, so you're totally in the dark.
