Brand Protection Letter (cease and desist)
Ive recently received an email from someone claiming to be a brand representative for Dr.squatch soaps, telling me I have to take of their listing or list it as used due to the fact that I am not a Dr.squatch authorized seller. But I have been brand approved and have been selling the soap for the past 3 months. I reached out to amazon, regarding the matter and they told me I could disregard the email since it was not provide from a amazon employee. Then couple days later I received a cease and desist email brand representative pretty much claiming that I will be unable to sell on amazon or legal actions may be taken. My question is how legitimate is this claim and can I get into Legal troubles, even though I am ungated for the product. I have had instances where sellers claim they are brand representatives to manipulate the market for their benefit so I am a bit skeptical. Thank you in advance for any feeback.

Unfortunately if you do not have the proper authorization from the brand to sell in Amazon you will be left hanging in the near future. When you mentioned that you have been approved by Amazon can you please explain in which way they authorized you? Did you submitted documents or you just were allowed to add your products to the listing?

If you don’t have a LOA from the brand owner, you’re not authorized. Amazon can’t authorize you to sell a branded item.

Just because Amazon said you could sell it doesn’t mean you are an authorized seller (you need brand approval or LOA).

Where are you sourcing your items? Do you have a LOA from Dr. Squatch to sell their products on Amazon?

Do you buy direct from Dr. Squatch or from a middleman?

You should email them and thank them for the warning, instead of filing a counterfeit/IP complaint against you, which would end your selling here indefinitely.
