BR got rejected, please Help

Hi please help me, we haven’t started selling one thing, AMZ already giving us so much headache.

We opened the shop under the “Shh boutique” this name, we also hired a Legal Zoom attorney to working on the brand TM, however she took a very long time. So we decided to sell the product without the brand first. We got the ASIN, but immediately AMZ locked the listing, two errors, one is related to BR, and another is for the product photo.

At that time, my LZ attorney still no news or any updates.

Luckily I met a local famous attorney. We started a second brand with him, did all the paperworks, and got the second brand serial number.

We submitted the BR application, but got got rejected. I thought it was the photo problem because we didnt submit with our product image ( we were still deciding )

Our attorney followed up with AMZ team, saying “We completed our investigation and can confirm this user has violated Amazon terms and conditions. They are not eligible for Brand Registry at this time. If they wish to appeal this decision, they will have to submit the appeal within their account.”

This is scary, I only have one account, 2 brands names. One has the TM in process, another one dont.

AMZ linked 2 brands together.

We want to move on.

Questions:

Is it possible to have AMZ to remove our first brand? ( NO TM )

If we do the appeal, is it possible to do on our own instead to hire some companies?

We haven’t sold a thing, already burned so much money.

I'm trying to get the whole history from reading your summary here but need some clarification. Currently you do not have any brands in Brand registry so what do you mean when you said "AMZ linked 2 brands together." I don't see this in the system and don't think this is the issue here.

If you don't have a trademark and just got approval to sell under a brand name, why would you want to remove it? Is this a duplicate brand name in which you registered the trademark for? In this case it should not be the issue if you got the trademark now.

Appeal processes needs to be completed by the seller, but a seller could ask other companies for advise. However, the appeal itself has to be completed by the seller.
