We obtained a Utility patent for our product, and are trying to report the infighting sellers, but keep on being rejected.
When reporting the violation, we must apply for APEX or they won’t accept the claim
And when applying for APEX one of the requirements is that we must have a court order or ITC order finding infringement
Is amazon now requiring having a court order to report infringement?

The attorney whom you used when securing your patent should be able to help you with a C&D letter or similar action. I would speak to them; they'll know how to navigate through the hoops (of course, they'll charge you for it, but shouldn't be too much)
