Competitor created duplicate listing for the same product under different brand

Hello all.

Competitor has created duplicate listing for the same product under different brand name. WE had reported this to Amazon, however we are getting same response from Amazon, there is no policy violation.

If any seller come across with the the same issue before, please assist us.

Your same product, is it branded? genetic? Do you have intellectual claims to the product itself? A patent?

So it is NOT the same thing and not only he is allowed but MUST create a new listing. If you don't own a patent for this exact design you can do nothing. Or would you prefer that he sells on YOUR listing?

We've noticed an increasing number of sellers using Brand Registry to circumvent the Duplicate Listing Policy

I hope you are doing well, there are no issues with that don't waste your time by complaining to the Amazon team, because they did private labeling you can do that too whatever product you see has good sales you can sell it by changing the brand name and entering into selling computation, what they can't is that they can't sell by your brand name if your listing is not under generic if you listed your product in the generic category they anyone can be a seller of that.

If you do not own the patent or rights to the product or have brand registry there is nothing you can do. The Chinese will just replicate it and sell it for a fraction of the price.

I have made reports for this, included the images from the listing showing one brand on the listing images and review images from the listing brand, even got a moderator involved. NOTHING. As you would expect, no violations reported. Nothing was done. If they have any sales volume, Amazon will let it slide because it would cost them money to enforce their own rules. The selective enforcement of marketplace policies will result in additional government entities suing Amazon or a class action suit against them. Arbitration agreements are not always enforceable.

Everybody is MISSING HIS POINT: He's not complaining about selling the same product, he's saying that the competition has created TWO LISTINGS OF THE SAME PRODUCT but under a different brand name. This is common with CN sellers.

I too am "competing" with a CN seller who - out of spite - created EIGHT LISTINGS of the SAME PRODUCT all using the same exact pictures (not mine anymore, but at one point they did) and prices, but with slightly different brand name variations. For instance: "Toner", "Toneur", "Toners", "Toneurs", etc. The parent company is just one CN seller with a name like this "jhsyehfksiouyathdslkfoanbgsytgdkl".

So what OP is basically saying is that this is unfair competition.

OP, I report these stores too, but in a day or two they pop back up with a different name variation. So don't waste your time doing Amazon's job for them, just sell your product at your price, and be done with it.
