Test buy Counterfeit
Hello Fellow Amazon Sellers and Amazon Forum Helpers!
I am in a bite of a pickle and am looking for advice from other sellers.
I have been selling this ASIN for over 1 Year and now getting the rights owner’s trademark counterfeit claim.
The listing does say ( brand ) His store but as we know as amazon sellers, those are bogus and they just put their store name instead of the actual manufacturer..
Please note that I have sold this item for over a year with no issues.
This item is unable to be trademarked and the claim I have been sent to my email address states that he is claiming I used his trademark ( His store name ) Not the actual item! The item is 100% genuine and I get it from a wholesaler based in the states.
Is there anything I can do? This seller is based in Lithuania, not in the united states so not sure if a lawyer could help.
The items are 100% legit and I have all invoices from wholesalers with authentic paperwork included.
Can you please point me in the right direction, should I contact a lawyer and send C&D?

We would appreciate the ability to upload images of our product and the test buy to demonstrate the clear differences between our authentic product and the counterfeit product sold by CoinsofQuality.
As the creator and designer of this product, I can confirm that the package design is unique and distinguishes our product from others on the market. We are confident that the product we received from CoinsofQuality is counterfeit, as it was simply a plastic bag filled with random cheap banknotes and did not include our unique banknote style label with the brand name.

Yes, this is called PRIVATE LABEL.
Why you don't just create your own private label and listing?
Since both of you buy from the same manufacturer, you both have to put your brand on each product. You cannot sell Pepsi-Cola on a Coca-Cola listing, even if the product is (almost) the same.

You are describing several different violation types. The path to resolve these violations is determined by the violation type. We would ask for further clarification about the exact nature of the violation.
"Test buy Counterfeit"
For counterfeit complaints, there are two kinds of issues. If your violation shows "Counterfeit without a Test Buy". If you are seeing this, then you will want to provide invoices for the listed ASIN. If the violation simply shows "Counterfeit", we would be looking for a dispute with a letter of authorization.

For trademark violations, your resolution path depends on if the violation reads "trademark on product" or "trademark on detail page" You will want to submit invoices or a letter of authorization for the "trademark on product" violation. If you are seeing "Trademark on detail page", invoices are not accepted. For that kind of violation, you would need to provide a letter of authorization.

If this is a copyright issue, then you would need to submit a DMCA claim.
You should also have the option to request a complaint retraction from the right's owner. This option would apply regardless the nature of the violation. Any retraction submitted to Amazon would have to come straight from the right's owner.
